THE COUNTY OF CAMBRIDGESHIRE (MILTON ROAD, CAMBRIDGE) (BUS/CYCLE LANES, MANDATORY CYCLE LANES, DUAL USE CYCLE TRACKS AND PROHIBITION AND RESTRICTION OF WAITING AND LOADING) ORDER 1995

The County of Cambridgeshire in exercise of the powers under Sections 1,2,3,4,19 and 64 of the Road Traffic Regulation Act 1984 ("the Act") and all other enabling powers after consultation with the chief officer of police in accordance with Part III of Schedule 9 to the Act hereby make the following Order:

COMMENCEMENT AND CITATION

1. This Order shall come into operation on 4th day of January 1996 and may be cited as "The County of Cambridgeshire (Milton Road, Cambridge) (Bus/cycle Lanes, Mandatory Cycle Lanes, Dual Use Cycle Tracks and Prohibition and Restriction of Waiting and Loading) Order 1995".

INTERPRETATION

2. (1) In this Order:-

"bus/cycle lane" means an area of a carriageway which is bounded by the kerbline thereof or a road marking in compliance with diagram 1010 of the Traffic Signs Regulations and General Directions 1994 and a longitudinal white line placed on the carriageway 3 metres from the said kerbline or road marking in compliance with diagram 1049 of the Traffic Signs Regulations and General Directions 1994;

"hackney carriage" has the same meaning as in Section 38(1) of the Vehicles (Excise) Act 1971 as amended;

"layby" means an area of carriageway which is bounded by the kerbline thereof and a road marking in compliance with diagram 1010 of the Traffic Signs Regulations and General Directions 1994;

"motor vehicle" means a vehicle as defined in Sections 136(1) and 140 of the Act:

"private hire car" means a vehicle being a motor vehicle constructed or adapted to carry fewer than 8 passengers other than a hackney carriage and duly licensed pursuant to Section 48 of the Local Government (Miscellaneous Provisions) Act 1976;

"prohibited hours" means 7am to 10am and 4pm to 7pm Mondays to Saturdays inclusive;

"public service vehicle" means a vehicle constructed or adapted to carry 8 or more passengers not being a hackney carriage or a private hire car;

"school bus" means a vehicle which is constructed or adapted to carry 8 or more passengers and is being used to carry persons to and from school as defined by Section 114(1) of the Education Act 1944;

"street works" means the carrying out of any street works authorized in accordance with the provisions of the New Roads and Street Works Act 1991 or emergency works as defined by Section 52 of that 1991 Act; and

"works bus" means a vehicle which is constructed or adapted to carry 8 or more passengers and which has been provided by an employer for the purpose of carrying persons to and from their place of employment and is being used for such a purpose.

(2) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment.

(3) Except where otherwise stated any reference in this Order to a numbered Article or Schedule shall be construed as a reference to the Article or Schedule bearing that number in this Order.

(4) The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

(5) The restrictions imposed by this Order shall be in addition to and not in derogation from any restriction or requirement imposed by any regulations made or having effect as if made under the Act or by any other enactment.

(6) In the case of conflict between any of the provisions of this Order or between the provisions of this Order and any other provision of any other enactment, restriction or requirement imposed by any regulations made or having effect as if made under the Act or by any other enactment the more restrictive provision shall prevail.

BUS/CYCLE LANES

3. Save as provided in Articles 4 and 5 no person shall, except upon the direction or with the permission of a police officer in uniform or a traffic warden, cause or permit any motor vehicle to enter, or proceed on or wait on the bus/cycle lanes marked on the roads or parts of road specified in Schedule 1.

4. Nothing in Article 3 shall render it unlawful to cause or permit any motor vehicle to enter, or proceed on or wait on the bus/cycle lanes marked on the roads or parts of road referred to therein if and so long as may be necessary to enable:

(i) a vehicle that cannot conveniently be used for such purpose in any other road to be used for the removal of any obstruction to traffic or being used in connection with street works;

(ii) the vehicle to be used for police fire brigade or ambulance purposes;

(iii) the vehicle to be used in the service of any local authority, water authority or public utility in pursuance of statutory powers or duties;

(iv) a person to board and alight;

(v) goods to be loaded on or unloaded from a vehicle at premises having an entrance from the side of the road on which the bus/cycle lane is situated and no other entrance provided that such loading or unloading as can be carried out only from the bus/cycle lane shall take place only whilst no prohibition of loading or unloading on the bus/cycle lane by virtue of any other order enactment or restriction is in force;

(vi) the vehicle to avoid an accident;

(vii) the vehicle to gain access to or egress from off street loading facilities or garaging;

(viii) the vehicle to cross the carriageway to gain access to or egress from premises situated adjacent to the carriageway and to which access cannot be gained from any other road; or

(ix) the vehicle to cross the carriageway to gain access to or egress from a layby.

5. Nothing in Article 3 shall render it unlawful to cause or permit any motor vehicle to enter or proceed on the bus/cycle lanes marked on the roads or parts of road referred to therein if the motor vehicle is:

(i) a public service vehicle;

(ii) a school bus; or

(iii) a works bus;

(iv) a hackney carriage

(v) a private hire car

WAITING RESTRICTIONS

6. Save as provided in Article 7 no person shall, except upon the direction or with the permission of a police officer in uniform or a traffic warden, cause or permit any motor vehicle to wait on the roads or parts of road specified in Schedule 2.

7. Nothing in Article 6 shall render it unlawful to cause or permit any motor vehicle to wait on the roads or parts of road referred to therein if and so long as may be necessary to enable;

(i) the vehicle to be used for the removal of any obstruction to traffic;

(ii) the vehicle to be used for police fire brigade or ambulance purposes;

(iii) the vehicle to be used in the service of any local authority, water authority or public utility in pursuance of statutory powers or duties;

(iv) a person to board and alight;

(v) goods to be loaded on or unloaded from a vehicle at premises having an entrance from the side of the road or parts of road and no other entrance provided that such loading or unloading as can be carried out only from the side of the road or parts of road shall take place only whilst no prohibition of loading or unloading on the roads or parts of road by virtue of any other order enactment or restriction is in force;

8. Schedule 2 to the City of Cambridge Area C (Consolidation) Order 1993 is hereby varied and shall have effect as though:

(i) in Part 1 the following words were deleted -

"MILTON ROAD On its southeasterly side from a point 21 metres southwest of its junction with Herbert Street for a distance of 39 metres in a southwesterly direction " ;

(ii) in Part 2 the following words were deleted:-

"MILTON ROAD On its northwestern side from its junction with Arbury Road for a distance of 66 metres in a northeasterly direction
MILTON ROAD On its southeastern side from its junction with Arbury Road for a distance of 66 metres in a northeasterly direction
MILTON ROAD On its southeastern side from a point 21 metres southwest of its junction with Herbert Street for a distance of 42 metres in a northeasterly direction
MILTON ROAD On its southeastern side from a point 145 metres south of its junction with Gilbert Road to a point 36 metres north of that junction
MILTON ROAD On its northwestern side from its junction with Chesterton Road (Northern arm) to a point 60 metres north west of its junction with Gilbert Road " ;

(iii) in Part 2 the following words were added:-

"MILTON ROAD On its northwestern side from its junction with Chesterton Road (Northern arm) to a point 186 metres southwest of its junction with Gilbert Road " ;

LOADING PROHIBITIONS

9. Save as provided in Article 10 no person shall, except upon the direction or with the permission of a police officer in uniform or a traffic warden, cause or permit any motor vehicle to wait, during the prohibited hours, for the purposes of delivering or collecting goods or merchandise or loading and unloading any motor vehicle on the roads or parts of road specified in Schedule 3.

10. Nothing in Article 9 shall render it unlawful to cause or permit any motor vehicle to wait, during the prohibited hours, for the purposes of delivering or collecting goods or merchandise or loading and unloading any motor vehicle on the roads or parts of road referred to therein if the vehicle is waiting in a layby.

11. Schedule 3 to the City of Cambridge Area C (Consolidation) Order 1993 is hereby varied and shall have effect as though:-

(i) in Part 8 the following words were deleted -

"MILTON ROAD On its northwestern side from its junction with Chesterton Road (Northern arm) to a point 60 metres north west of its junction with Gilbert Road
MILTON ROAD On its southeastern side from a point 145 metres south of its junction with Gilbert Road to a point 36 metres north of that junction " ;

(ii) in Part 8 the following words were added -

"MILTON ROAD On its northwestern side from its junction with Chesterton Road (Northern arm) to a point 186 metres southwest of its junction with Gilbert Road " ;

(iii) the following Part was added:-

"PART 11
ROADS AND PARTS OF ROADS IN WHICH WAITING IS PROHIBITED FOR THE PURPOSES OF DELIVERING OR COLLECTING GOODS OR MERCHANDISE OR LOADING OR UNLOADING VEHICLES BETWEEN 12.45PM AND 2.15PM

MILTON ROAD On its southeastern side from a point 145 metres south of its junction with Gilbert Road to a point 36 metres north of that junction
MILTON ROAD On its northwestern side from its junction with Chesterton Road (Northern arm) to a point 60 metres north west of its junction with Gilbert Road " .

DUAL USE CYCLE TRACKS

12. Schedule 22 to the City of Cambridge Area C (Consolidation) Order 1993 is hereby varied and shall have effect as though the following words were added:-

"MILTON ROAD The footway on the north west side from its junction with Arbury Road to a point 186 metres south west of its junction with Ramsden Square
MILTON ROAD The footway on the north west side from its junction with Gilbert Road to a point 50 metres northeast of its junction with Highworth Avenue".

CYCLE LANE

13. Part 2 of Schedule 23 to the City of Cambridge Area C (Consolidation) Order 1993 is hereby varied and shall have effect as though:-

(i) the following words were deleted:-

"MILTON ROAD The southeastern side from its junction with Green End Road to its junction with Union Lane
MILTON ROAD The northwestern side from its junction with Arbury Road to its junction with King's Hedges Road
MILTON ROAD On its northern side from the junction with Gilbert Road to the junction with Elizabeth Way
MILTON ROAD On its southern side from the junction with Herbert Street to the junction with Elizabeth Way " ;

(ii) the following words were added:-

"MILTON ROAD The southeastern side from its junction with Green End Road to a g point 40 metres southwest of its junction with Woodhead Drive
MILTON ROAD The northwestern side from its junction with King's Hedges Road to a point 40 metres southwest of its junction with Woodhead Drive
MILTON ROAD The northwest side from a point 186 metres southwest of its junction with Gilbert Road to its junction with Gilbert Road
MILTON ROAD The southeast side from its junction with Arbury Road and Union Lane to a point 30 metres northeast of that junction ".
